TRIBAL LAW IN INDIA

Tribal communities have been obeying customary laws through their traditional panchayats since long. Vast literature is available on religion, culture, marriage and family traditions of tribal communities living in the Fifth Schedule states or in autonomous hill districts of the north-east covered by the Sixth Schedule of the Indian Constitution. It was only in 1996 that Panchayats (Extension to Scheduled Areas) Act was enacted by parliament and it was enjoined upon the states having scheduled areas therein to adopt it within one year. Perhaps no exercise has yet been made to analyze in details the codified law as being implemented in the Fifth Schedule states till date and difficulties encountered in its implementation in the light of recommendations of the Bhuria Committee. In this book, an effort has been made in this direction to study laws applicable to tribal communities in different parts of India.

TRIBALS AND COMMUNITY FOREST MANAGEMENT

The history of forest governance and policies in India presents an interesting blend of conservation and exploitation of the forests. Notwithstanding several measures taken to prevent depletion of forests in the past, the destruction of forests has continued. This has not only destroyed the traditional institutions of managing forests, but has also caused gross ecological imbalances. The forest policy in India, with its colonial attributes, continues to look upon forest-dependent communities not only as aliens in their own lands ignoring their rights, but even treats them as destroyers of forests.

UP AGAINST CASTE: Comparative Study of Ambedkar and Periyar (Revised Second Edition)

The struggle for social justice and human rights in India is inextricably linked to the question of caste and the continuing caste-based social structure.
Struggles against caste and the caste system have a long history. In modern times the contributions of B.R. Ambedkar and E.V. Ramasami (popularly known as Periyar) are particularly significant. Ambedkar, hailing from an untouchable caste background, was the pioneer in teaching the untouchables the art of using political weapons for the betterment of their conditions. Through his scholarly works and social and political struggles, Ambedkar challenged the Brahminical order of society and sought to uphold the basic human rights of the depressed classes. E.V. Ramasami’s contributions were no less significant. The imprints of his struggles are to be found in the social and political spheres of the Tamil region in southern India. His challenge to Brahminism was sought to be posited through an alternative, democratic culture. The book presents a unique comparative discourse on the ideas of Ambedkar and Periyar.
